EchoSight Terms of Use and Service

1. Scope

These terms govern use of the EchoSight website and services. By engaging EchoSight, you agree to these terms unless otherwise agreed in writing.

2. Services

EchoSight provides ecological consultancy, survey support, data analysis, and related professional services on a best-endeavours basis, in accordance with the agreed scope and current professional guidance.

3. Professional judgement

Ecological work involves interpretation and professional judgement based on available data and prevailing guidance at the time of assessment.

EchoSight does not guarantee planning outcomes, licensing decisions, or regulatory approvals.

4. Intellectual property

Unless otherwise agreed in writing:

  • Copyright in reports, datasets, imagery, and outputs remains with EchoSight.
  • Clients are granted a licence to use outputs solely for the agreed project purpose.
  • Reuse beyond the original scope requires written permission.

5. Use of recordings and survey outputs

EchoSight may generate recordings, imagery, video, thermal footage, acoustic data, and associated metadata during surveys or analysis.

Unless otherwise agreed in writing:

  • Raw and processed recordings remain the intellectual property of EchoSight.
  • Clients retain full rights to use deliverables for their project and regulatory submissions.
  • EchoSight may also retain copies of recordings and derived outputs for internal training and quality assurance, development, testing, and improvement of analytical tools and workflows, and professional portfolio, presentations, and non-commercial marketing.

Where such material is used:

  • Site names, client names, and sensitive project details will be removed or anonymised unless explicit permission is given.
  • Material will not be used in a way that compromises client confidentiality or regulatory processes.

If a client requires exclusion from secondary use, this must be agreed in writing prior to project commencement.

6. Confidentiality

All client information is treated as confidential unless disclosure is required by law or agreed in writing.

7. Limitation of liability

To the maximum extent permitted by law:

  • EchoSight is not liable for indirect or consequential losses.
  • Liability is limited to the value of the services provided.
  • Nothing excludes liability for death, personal injury, or fraud.

Professional Indemnity and Public Liability insurance are maintained.

8. External links

EchoSight is not responsible for the content or privacy practices of third-party websites.

9. Governing law

These terms are governed by the laws of England and Wales, with exclusive jurisdiction of the English courts.
